General

The time of delivery will be dependent on stock availability. Should stock be available, orders will be dispatched within the following two working days from the day the payment is validated/received. For large orders a longer time will be needed.
Should the product be unavailable, Nostalgia Flowers will contact you directly with a delivery time estimate.
Every effort is made to get your order on time, however unforeseen events may cause delays, i.e. courier companies having logistical problems. Should we be faced with such an occurrence Nostalgia Flowers will contact you directly with a revised delivery schedule.
All orders placed on Fridays will be processed the following business day. Public holidays will also be taken into effect and orders will be finalized thereafter.

Privacy Policy

Delivery

Delivery of goods shall be made by Nostalgia Flowers to the Buyers’ selected delivery point unless the seller’s address has been selected by the Buyer as collection point. The Buyer will be liable for the cost to deliver the ordered goods.
Buyers will be notified in advance should there be any changes to deliveries.
Please ensure the correct shipping address is provided from the outset as title and risk will pass to you once the order has left our premises. We take no responsibility for orders that have wrong information.
Buyers are required to be on time for collection at selected collection points. If buyers are late for collection or cannot make a collection at the selected collection point at the notified time. it is their responsibility to contact Nostalgia Flowers and arrange an alternative collection point. Buyers who fail to collect goods will be liable for the full amount of the goods ordered.
Due to the nature of fresh cut flowers, Nostalgia Flowers is not liable for costs incurred by the Buyer for goods ordered which cannot be delivered. The Seller will give the Buyer advanced notice of goods ordered which cannot be delivered and will after consultation with the Buyer endeavour to replace or substitute goods ordered.

Price of Goods

Nostalgia Flowers endeavours to offer you competitive prices on current products; your total order price will include the price of the purchase plus any applicable sales tax (VAT) delivery charges will be added to the cost of the product to be delivered and it will be for the buyers account.
All transactions will be processed in South African Rand (ZAR).
Nostalgia Flowers reserves the right by giving notice to the Buyer at any time before delivery to increase the price of the Goods to reflect any increase in the cost to the Seller which is due to any factor beyond the control of the Seller or to any change in delivery dates, quantities or specifications for the Goods which is requested by the Buyer.

Terms of Payment

Subject to any special terms agreed in writing between the Buyer and Nostalgia Flowers, the Seller will invoice the Buyer for the price of the Goods at any time before delivery of the Goods.

Payment Options and Pricing

Nostalgia Flowers reserves the right to change pricing at any time without prior notice.
If a payment is not received or payment method is declined, the buyer forfeits the ownership of any items purchased. If no payment is received, no items will be shipped. Items will stay the property of Nostalgia Flowers until full payment has been received.

Order processing

Order processing will not begin until we receive a confirmed order and full payment. For EFT’s this means that we cannot process the order until the funds have cleared in our account (which is normally within the next 2 – 3 business days).

Quality Complaints

The Buyer must lodge quality complaints within 24hrs of the delivery of the Goods, after which the Buyer will be liable for the full amount of the invoice. Complaints must be uploaded onto the Seller’s website under the Buyer’s profile. The complaints must be accompanied by pictures and a description of the complaint.

Cost incurred for Product courier returns that was not a direct fault on Nostalgia Flowers side will be for the customer’s account.

Monitoring

We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Terms and Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating, or attaching conditions to your access and/or removing any materials from the Website).

Law

The Terms and Conditions will be exclusively governed by and construed in accordance with the laws of the Republic of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
The seller is not responsible for any health or safety concerns once the buyer has received the item. If any harm is incurred from the items purchased by the buyer, the seller shares no responsibility. The designs and printing on packages remain the property of Nostalgia Flowers and may not be reproduced or copied in any way!

Intellectual Property

The Site and all of its original content are the sole property of Nostalgia Flowers and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws.

Changes to This Agreement

Nostalgia Flowers reserves the right to modify, add to or remove from portions or the whole of these Terms of Service at any time. Your decision to continue to visit and make use of the Site after such changes have been made constitutes your formal acceptance of the new Terms of Service. Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access the Nostalgia Flowers site immediately.

Consent

I understand that all the designs and trademarks are registered to Nostalgia Flowers (Pty) Ltd. and hereby accept the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by Nostalgia Flowers for any civil action or any legal action deemed necessary against me.
